Article 2 - Application of these terms and conditions :

These terms and conditions apply to all purchases made from SCEA CHATEAU JOLYS via the www.chateaujolys.fr website. To find out the terms and conditions of an order, the customer may click on "Terms and Conditions of Sale" at any time, even before placing an order.

The fact of placing an order implies the full and unrestricted acceptance by the SCEA CHATEAU JOLYS customer of the various clauses presented in these GCS. Only a written agreement stipulating special conditions between the two parties can be accepted, without this these conditions thus presented are subjected by right in the existing contractual relations between the Customer and the company SCEA CHATEAU JOLYS. 

The offers presented by SCEA CHATEAU JOLYS are reserved for private customers and legal entities such as companies and groups.

Before validating his order, the customer declares that he has accepted these terms and conditions of sale and that he therefore fully agrees with them.

Article 3 - How to order :

All orders are placed through www.chateaujolys.fr

The customer builds up a basket by choosing the number of products he or she wants. Once they have made their selection, customers validate their basket and payment method. 

Once you have accepted the General Terms and Conditions of Sale, your order becomes final when it is validated by payment for the products. 

The verification department has the right to cancel certain orders if it considers that the latter present various anomalies and irregularities. (doubts about the customer's identity, usurpation, creation of irregular accounts, etc.).

An invoice is issued by SCEA CHATEAU JOLYS and is available in the "my account" section of the www.chateaujolys.fr website. At the customer's request, an invoice can be sent by e-mail, or to the customer's billing address. An order confirmation is sent by e-mail.

In accordance with the terms of the law n°80 336 of May 1st 1980, relating to the reserve of property, the products remain the property of SCEA CHATEAU JOLYS until the integral payment of the invoices.

The customer becomes the owner and responsible for the articles upon delivery, and the transfer of possession is tantamount to the transfer of risk.

Article 4 - Payment methods and prices :

Payment can be made by cheque, bank transfer or credit card.

Credit cards :

Cards bearing the initials CB, VISA, EUROCARD, MASTERCARD or AMERICAN EXPRESS are accepted. 

Cheques :

Cheques in Euros only and domiciled in France only.

B: Price :

For France, prices are expressed in Euros (€) and include all taxes (French VAT and all other applicable taxes). 

The price indicated on the product sheets does not include shipping costs. The price of the same product may vary according to the quantities selected. Shipping costs vary according to the delivery method chosen by the customer and the country of delivery.

All promotional operations (vouchers, discount vouchers, partner discounts, etc.) are limited to one person per household and per operation. SCEA CHATEAU JOLYS reserves the right to refuse orders that do not meet this criterion. 

Article 5 - Delivery : 

National delivery: On receipt of payment for the order, SCEACHATEAU JOLYS initiates transport and delivery operations. Items ordered are delivered to the address provided by the customer. The delivery information provided by the customer is binding. The company SCEACHATEAU JOLYS cannot be held responsible in the event of an error or lack of information resulting in faulty or non-delivery. In the event of a return due to an incomplete address, the customer will have the option of modifying the address and having the merchandise reshipped at the customer's expense, or being reimbursed for the order minus the initial shipping costs.

Community delivery: For customers wishing to have their products delivered to an EU country mentioned in the list of countries delivered (Transport and Delivery), in the same way as a national delivery, the company SCEACHATEAU JOLYS will take care of delivery. 

Delivery times: SCEACHATEAU JOLYS undertakes to do its utmost to deliver the products ordered as quickly as possible. Delivery times vary according to the product, the delivery method chosen and the country of destination of the goods. If products in an order have different delivery times, the longest delivery time will apply to the entire order.

CAUTION: IN THE EVENT OF DAMAGE OR BREAKAGE

IMPORTANT: The carrier is responsible for the integrity of the package during delivery.

It is the customer's responsibility to check the contents of the parcel and to express precise and motivated reservations stipulating the damage, if necessary, by writing them on the delivery slip or the electronic box provided by the carrier. The customer may also refuse the package if its integrity has not been preserved.

In all cases, the customer must notify the company SCEACHATEAU JOLYS within 10 days at: contact@chateaujolys.fr or by telephone on 05.59.21.72.79 If all the above conditions are met, the company SCEACHATEAU JOLYS undertakes to offer a reshipment, a credit note or a refund to the aggrieved customer.

Article 6 - Stock and out-of-stock :

In the event of a product ordered being out of stock, SCEACHATEAU JOLYS undertakes to keep the customer informed as soon as possible and will offer different alternatives:

      Replacement of the out-of-stock product by the next vintage or by an equivalent or higher-quality product at the same price.

     -Refund of the unavailable product(s) or the entire order, depending on the customer's choice.

In the event of a temporary shortage, the customer will be offered the choice of waiting until the date indicated for restocking. The customer will have the option of accepting and waiting to receive the full order, or requesting partial or full cancellation of the order.

Article 7 - Right of withdrawal :

Conditions

You have the right to withdraw from this contract without giving any reason within fourteen days.

The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods.

To exercise this right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post or e-mail). Please find here the withdrawal form.pdf

In order for the withdrawal period to be respected, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.

Effects of withdrawal

In the event of your withdrawal from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs arising from the fact that you have chosen, where applicable, a delivery method other than the least expensive standard delivery method offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract.

We will make the refund using the same method of payment you used for the original transaction, unless you expressly agree to a different method, in which case there will be no charge to you. We may defer reimbursement until we have received the goods or until you have provided proof of shipment of the goods, whichever comes first.

You must return the goods in person or send them to us at SCEACHATEAU JOLYS -330 Route de la Chapelle de rousse, 64290 GAN without undue delay and, in any event, no later than fourteen days after you have informed us of your decision to withdraw from this contract. This period is deemed to have been respected if you return the goods before the fourteen-day period has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods. In the event that certain products have been opened or consumed, SCEACHATEAU JOLYS will be entitled to deduct these products from the refund made to the purchaser.

Article 8 - Applicable law and dispute resolution :

You have 2 options: 

• Consumer Mediation Service : 

Amicable settlement of disputes between the professional and the consumer in accordance with articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the French Consumer Code.

In the event of an unresolved dispute between the professional and the consumer, the consumer has the possibilitý to refer the matter to the consumer mediator. 

Before referring the matter to the consumer mediator, the consumer must alreadỳ have attempted́ to resolve his or her dispute directly with the professional by means of a written complaint, or have made a complaint under the terms of the contract concluded with the professional.

Consumer mediation is an out-of-court settlement of consumer disputes.

If the conditions are met, a consumer mediation will be carried out according to a precise process and in compliance with the texts in force.

Applicable law and jurisdiction

These terms and conditions are governed by French law. Should any clause of the present conditions prove to be null and void, this shall not affect the validity of or compliance with the present conditions. In the event of persistent disagreement concerning these terms and conditions, and in the absence of amicable agreement, any dispute will be referred to the competent French courts.

Repayment terms

In the event of a refund due to a dispute, we undertake to refund the amount agreed with our customer service department without undue delay and no later than fourteen days from the date on which you agreed in writing to the refund with our customer service department. In the event of a refund in exchange for returned goods, we may defer the refund until we have received the goods or until you have provided proof of shipment of the returned goods, whichever comes first. For credit card refunds, please note that interbank delays may delay the actual credit to your account by a few days.

 Article 9 - Legal warranties

 SCEA CHATEAU JOLYS is liable for any lack of conformity of the wine(s) under the conditions of articles L.217-4 et seq. of the French Consumer Code and for any hidden defects of the wines sold under the conditions of articles 1641 et seq. of the French Civil Code.

 When acting under the legal warranty of conformity, you :

 You have two (2) years from the delivery of the wine to take action;

• Can choose between repair or replacement of the item, subject to the cost conditions stipulated in Article L. 217-9 of the French Consumer Code;

• Are exempted from proving the existence of the lack of conformity of the wine during the twenty-four (24) months following the delivery of the wine.

The legal warranty of conformity applies independently of any commercial warranty.

You may decide to invoke the warranty against latent defects of the item sold within the period stipulated in article 1648 of the French Civil Code, as defined in article 1641 of the French Civil Code. In this case, you may choose between rescinding the sale or reducing the purchase price, in accordance with article 1644 of the French Civil Code.

Article 11 - Protection of minors :

The provisions of the French Public Health Code concerning the sale of alcohol to minors were amended by article 93 of the HPST law. The sale of alcohol to under-18s is now prohibited.

At the time of registration, the customer must be of legal age. Furthermore, with each order, at the time of validation and before payment, the customer, by accepting these GTC, will once again acknowledge his or her majority.
